Breaking rule one or two will get you time off from the website. Breaking rule 3 will get you shot at sunrise and then drawn and quartered.

I like this topic but Rule # 2  leaves out everyone but family. I took approx 3100 pics of the 2AA west regional but did not have time to get waivers from all the players,coaches,cheerleaders and people in the stands that showed up in most of the pictures, in the background???

I think it's directed towards the idea that if they object being in the picture and especially the picture being on the net, then don't post it.

You dont have to get waivers do you ? They are in a public place you can take their picture.

If you had the permission of an event's organizer to take the pictures, there should be no problem. If someone complains about a specific picture it would then be removed.

You dont have to get waivers do you ? They are in a public place you can take their picture.

I don't know the exact laws at work here, but I know that where I work, we have to have written permission to use any photographs on our website.  If we don't have permission, we don't make a picture public.  This has changed in the past couple of years.  However, you see pictures posted on social networks all the time.  So, it seems to be a gray area.  I think we are a little nervous to post, because we're not sure what we can and can't do!

There's no gray area. If you take a photo in a place where there isn't an expectation of privacy, you can publish it. A person can't go to a football game or walk down the street and expect to remain private. If you have permission to be in a public place, you can take a photo and use it. Restrooms, hospitals, and the like are places where there is an expectation of privacy....

However, the bigger problem I see on this forum is the issue of copyright...it's the main reason why I haven't posted anything. The law is simple, yet I see it broken so many times on here....

If you take a picture for any entity (e.g., newspaper, magazine, parent, website), they own the copyright. As such, you have to receive permission (licensing) from them to use the photograph in any way.

I've also seen on here where people have said they used a press pass to get in the game, and then posted photographs from said game. That's illegal. If you used their pass to get in the game or down on the sideline, then the photo is their property and you can't post it on here without permission.

Seeing as the majority of my work is for the Associated Press, WEHCO Corporation, University of Arkansas, or magazines and websites, I'm not going to jeopardize my standing with them just to get my ego stroked. I may occassionally secure permission for some of the bigger games I shoot or post some of my work from my personal business, but I, for one, won't be subjecting myself or this website to liability issues by posting every photo I take at a game just because I can get down on a sideline.

Everyone should go to the U.S. Copyright Office and read about copyright law, and then go to the library and pick up a journalism law book and read it. There's lots to be learned by posters on this website....

if you are freelance, however, most of the time all the paper/magazine requires is "first publication rights" the photos belong to you as long as they've either a. published them or b. passed the opportunity to publish them.
